These terms apply when you use this website or engage Progon Services LLC (“Progon,” “we,” “us”) for services. By using this site or hiring us, you agree to them.

Our services

We provide branding & web design, digital marketing, and business management & consulting. The specific scope, deliverables, timeline, and price for any engagement are set out in a separate written proposal, agreement, or invoice, which controls if it conflicts with these terms.

Quotes and payment

Quotes are provided in writing and are valid for the period stated on them. Work begins as described in your proposal or agreement, and invoices are due as stated there. We may pause work on accounts with overdue balances.

Your responsibilities

You agree to provide accurate information, timely feedback, and any content or materials needed for your project, and you confirm you have the rights to any materials you give us to use.

Intellectual property

When your project is paid in full, ownership of the final deliverables created for you transfers to you. We keep ownership of our pre-existing tools, processes, and know-how, and unless you ask otherwise in writing, we may show finished work in our portfolio and marketing. Third-party assets (fonts, stock images, plugins, platforms) remain governed by their own licenses.

Third-party platforms

Some features of this site and our services — such as appointment booking, chat, and hosting — run on third-party platforms. Your use of those platforms is also governed by their own terms and policies.

No guarantees

We work hard to get results, but marketing and business outcomes depend on many factors outside our control. We do not guarantee any specific ranking, traffic, revenue, or other result. See our Legal Disclaimer.

Limitation of liability

To the fullest extent permitted by law, Progon's total liability for any claim related to this site or our services is limited to the amount you paid us for the specific service at issue, and we are not liable for indirect, incidental, or consequential damages such as lost profits.

Termination

Either party may end an engagement as described in the applicable agreement. You remain responsible for payment for work completed up to the end date.

Governing law

These terms are governed by the laws of the State of Colorado, and any dispute will be handled in the courts located in Boulder County, Colorado.

Changes

We may update these terms from time to time. The date at the top shows when they were last revised, and continued use of the site after a change means you accept the updated terms.
